Hi,

I accidentally hit the black civic car of my first cousin that was parked inside our compound. It happened during the night of 'habagat" August 6. I was driving my montero in reverse and did not see the car on my side mirror due to heavy rains.

I have a comprehensive insurance on my car while my cousin only has TPL insurance.

My car Insurance told me that they can only cover my car because the car of my cousin is not considered a "Third Party" since the owner is my relative.

I hope to get your opinion on this matter. Thank you.

I forgot to mention that they said they could not cover the car of my cousin because of the THIRD PARTY definition on the contract. Below is the definition.

"THIRD PARTY is any person other than a PASSENGER as defined in the law and shall also exclude a member of the household, a member of the family within the second degree of consaguinity or affinity, of a motor vehicle owner or his employee in respect to death, bodily injury or damage to property arising out of and in the course of employment."

Was the damage big? If it's just a small ding, it might be cheaper to just have it repaired by yourself.

Well, if that's the stand of your car insurance, there's nothing much we can do about it. Most insurance companies typically do not want to shoulder the repair expense of the car you hit because...well...they're trying to do business and not lose money.

Damage on civic are scratches and dents on left fenders and driver's door. There are also scratches on the side mirror.

Anyway, I was surprised that car owned by our relatives (up to 2nd degree) is not considered as Third Party.
